Thankfully, our law firm has never had one of these issues, but the risk is real, and it’s important for buyers and sellers to understand how to protect themselves.

The most common scenario is when criminals send an email pretending to be the escrow company. The email looks legitimate, but it contains fake wire instructions. An unsuspecting client wires funds to the wrong account, and recovering that money is extremely difficult. That’s why one of the most important rules is this: escrow instructions never change. If you ever receive an email saying the instructions have been updated, that’s a huge red flag.

To reduce these risks, we always recommend using escrow companies that offer encrypted communication platforms. These platforms provide a secure online portal where the buyer and seller can review escrow agreements, instructions, and updates—all in one protected place. By limiting communication through email, the risk of interception or fraud drops significantly.

Even when encrypted platforms aren’t used, there are other safeguards. Escrow companies in Cabo routinely ask for the buyer’s and seller’s phone numbers. Many clients wonder why this is necessary, but the reason is simple: the escrow officer will actually call both parties to confirm that the wiring instructions are correct. This double-check provides another layer of protection.
